THREE KEY POINTS OF TALK:

1. Learning when to conduct an internal investigation. Many laws impose affirmative obligations on employers to conduct internal investigations when a written or oral complaint is made. Some laws-- and prudence-- impose a duty to investigate when no complaint is made. Participants will learn about both.

2. Identifying who should conduct the internal investigation. We will consider the pros and cons of utilizing a member of management, company counsel, and a third party investigator.

3. Understanding the purpose of the investigation and the deliverable. Participants will learn to keep their eye on the ball-- what should a company expect to have at the end of an investigation, and what should they do with it? And how will that protect a company from liability?
