SUMMARY:
Over the past few months the NLRB has taken actions that fundamentally change the manner in which employers may respond to union organizing efforts. New election rules radically shorten the time frame between the filing of a unionization petition and the subsequent election to as little as fifteen days; limit the employer’s right to challenge the union’s bargaining unit or voter eligibility; and require the employer to provide increased employee contact information to the union. These changes will result in a much higher success rate for unions attempting to organize new members. In addition, in the Purple Communications case, the NLRB has granted access to employers’ email systems for union organizing. This case represents a continuation of the trend of the NLRB attempting to expand its influence over non-union employers. Labor and employment attorneys, Jay Fries and Kathleen Talty of FordHarrison and, will detail the Board’s recent actions, discuss the consequences for employers, and suggest practical steps that employers should take now to minimize their vulnerability to future union organizing.
